I had posted last weekend about my truck literally being run over by a Waste Management garbage truck. It's been decalared a total, my insurance company has offered a fair settlement for it and is taking care of me.

What I can't believe is the conduct of Waste Management. From day one their lawyers came out swinging and intimidating. I won't go into details since this is currently in dispute. They have denied any responsibility and I will be out my deductible until the insurance companies settle. The lady who stopped and gave a statement and was extremely helpful on the day of the inident now can not be reached and is not returning phone calls.

What I've learned from this week, it's not about right and wrong and establishing fault, it's about who has the best attorney and files first.

Glad to hear your insurance company is taking care of you.

I hope the whole thing turns out right too. I remember when you said the guy came across like 7 lanes of traffic to run over you too....

Yes, let the insurance company's duke it out.

Either way, you are gonna be out some cashola ...

I was turning into a parking space in a parking lot, when a bozo at 30mph+ decided to pass me on the right side.

I took pics, measured his skid marks, established I was stationary and submitted it all to HIS insurance company.

Fault was deemed 50/50 ... I was 50% at fault for just being at the wrong place at the wrong time.

Insurance companys are NOT your friend ...

If he was passing illegally, I'd have fought that one. If he'd been passing legally, he'd not have hit you. That is the crap that makes me really angry about insurance companies.

I knew it. When you first told me this story and that the garbage truck driver was not ticketed that they would try to screw you. Hopefully your insurance company will fight for you and not just cave.

Inusrance companies are the worst! When some senial old lady went through a stop light her company said that I could have been driving differently and kept 5% of the claim for themselves. They told me they only give out 100% of a claim if the car was PARKED or if I was sitting at a traffic signal!! This was after I had 2 witnesses who said this old hag was sitting there at the red light, then just decided to go through it because no traffic had past for a while!!! I tried to get my insurance after them, but I didn't have full coverage on that car so they wouldn't help. I have full coverage with them on 3 other cars under the same policy and they still said sorry, we can not help with THIS car.

If she was just a hair quicker I would have driven right into her driver's door. I'm sure they would have preferred that since they wouldn't have to pay for her totaled car too! Then it cost me $85 to get the car towed half a mile! (IMG:http://www.frrax.com/rrforum/style_emoticons/default/mad.gif) I was tempted to drive it that far with the bent spindle, flat, broken front brake line, twisted frame, and cracked windshield.

In Jersey no one gets a ticket for causing an accident unless the cop is a witness, go figure!

You have my sympathy.

Sorry to hear about your truck. I hate it when insurance companies try and screw over their own customers, but you will just have to wait and see how it all pans out. Charging you the deductible is standerd practice until things get sorted out. Now if they raise your rates to then your getting screwed. Of course there is the alternitive of not having insurance and having the Waste Management lawyers rake you over the coals. At least your insurance company is fighting somewhat for you.

Bottom line is insurance companies are out to make money, that's why they are in buisness. It is low to make money off of someone's misfortune and that's why they get a bad rap. Imagine the world without insurance companies. Someone in a truck creams you then yourat a total loss and are you going to front thousands of dollars to a lawyer for a possible win? No way would I gamble with $6000 in lawyers fee's for a possible $10,000 to $12,000 pay off.

That sucks, but check this out. Last summer I was hit from the left by a dragster at Virginia Motorsport Park, which is private property. He was returning from a pass. The car was a '68 Camaro with a glass front end. He hit my '86 F-150 so hard it took the tire off the rim on the RIGHT side. The frame was bent , the door on the right wouldn't open, and there was a gap of over 3 inches between the cowl and the hood. Driver gets out screaming WTF was I doing? The owner comes up calling ME an ignorant SOB, MF etc. I keep my cool because I know I'm not at fault. I finally have enough of this ass, and tell track security to make him leave or he'll get the fight he's trying to start. The driver needs stitches, but refuses medical transportation. To make a long story short...my insurance company COVERS these assholes! Poor driver couldn't work for a week because of 5 stitches, the candy-ass. The story they get is that I was speeding. Was in an area I wasn't supposed to be in, and besides, the driver was hurt. I had permission to be where I was, and if I was speeding, how the hell did a 2800# racecar twist the frame on a 4500# truck? He was hurt only because he had unbuckled his harness. A friend of a friend bowls with the driver and said he later admitted to running around 45-50 mph,(the speed limit is 15mph), but still felt it was my fault. If it ever happens again on private property, I'll tell them to call the police, or KMA. and the next jerk that swears at me like that will need a trip to the dentist as well. Thank you.
