Long story short, tree branch falls on car at office, no dents but a lot of paint damage to my car and another co-workers. Employer says we're not responsible for what happens to your car in the parking lot talk to the property management company. Property management company says they are not responsible for acts of God talk to your insurance company. Insurance company claims they aren't responsible either, I can claim on my policy but I'll have to pay my deductible and risk a rate increase.

This sucks, the only thing I did wrong was park in my assigned spot. Anyone know of a Johnny Cochran look-a-like? I figure that if a little old lady in Albuquerque can extort a million from McDonald's over spilling hot coffee, a new paint job for a Camaro ought to be worth at least a few thousand.

Hail, tornados, earth quakes and floods are acts of god. A branch falling out of a tree that property management company had planted is not an act of god. But I'm no lawyer.

I'm guessing mng co is responsible. imagine the line of lawyers knocking on your door if that branch had landed on your head.

Same with my company. But they reserve the right to search any vehicle on the premises.

They only control the parking lot when it serves their purposes. (IMG:http://www.frrax.com/rrforum/style_emoticons/default/rolleyes.gif)

What kind of shape is the tree in? If it's neglected/dying, you'd probably have better grounds for making them pay.

I'm with Obssd.. I didn't think we were going through any kind of weather out here that could be considered an "act of God" to down tree branches. Sounds like the property management company should be at fault for not performing maintenance on the landscaping. Get some photos and see if you can get your insurance company to send them a nastygram.
